QLS BACKS RETAIL LEGISLATION AMENDMENTS

THE state government has made amendments to leasing laws for the retail sector, in a move congratulated by the Queensland Law Society (QLS).

According to QLS president Bill Potts, the new Retail Shop Leases Act Amendment Bill 2015 which recently passed will provide more clarity for all owners, buyers and sellers within the retail market.

The government adopted a number of QLS recommendations during the drafting process, which Potts says has resulted in a fair outcome.

"I am pleased that the government has listened to concerns identified by QLS," he says.

"The broad stakeholder consultation which has occurred is a great example of how the interests of all parties can be accounted for and addressed during the legislative review process."

Potts says early and broad consultation is the key to good law, as the society continues to support statutory review across a range of sectors.

"QLS is also supportive of periodic statutory reviews to ensure that legislation such as the Retail Shop Leases Act 1994 continues to reflect the expectations of the industry and the community."

Updates to the Retail Shop Leases Act as recommended by the QLS will allow already working processes to continue with relation to leases being assigned.

The new legislation also works to clear up previous technical drafting issues.
